A high-volume county where preparation and documentation make a measurable difference. If CFS has contacted your family, knowing what to expect changes your options.
The decisions you make at the beginning of a CPS investigation can have a lasting impact on your family. Before you speak with CFS, speak with an attorney.
The primary courthouse for CFS dependency cases in San Bernardino County. Our firm appears here regularly.
Families in the High Desert, meaning Victorville, Hesperia, and surrounding areas, may be assigned to a different courthouse. Our firm handles these cases through referral to trusted local counsel. Contact us and we will make sure you are connected with an attorney who knows that courthouse.
A social worker wants to speak with you. They may ask to see your home, interview your children, review medical records, or sign documents. You may feel pressure to cooperate immediately because you believe doing so will make the investigation go away.
The reality is that every decision made during a CPS investigation can affect what happens next.
Many parents assume they do not need an attorney unless a court case is filed. By then, critical statements have already been made, records have already been created, and the agency has often formed opinions about the family.
Our goal is not to create conflict where none exists. Our goal is to help families understand what is happening, protect their rights, and make informed decisions throughout the investigation process.
The earlier a family receives legal advice, the more options are often available.
If San Bernardino County CFS has contacted your family, schedule a CPS Investigation Strategy Session to discuss your situation and develop a plan for moving forward.
San Bernardino County carries one of the largest dependency caseloads in Southern California relative to its resources. Investigation timelines stretch longer than they should. Written reports from social workers may arrive late, or not at all before a hearing. The agency's process is often slower and less consistent than in other counties.
That inconsistency is a reason to document everything. Every call. Every missed appointment. Every promised referral that did not arrive. A well-documented record of the agency's own delays and failures can be the difference between a case that drags on and one that moves in your favor.

In California, social workers can only remove a child without a prior court order in narrow emergency circumstances where they believe there is an immediate threat to the child's safety. San Bernardino County CFS must then file a petition and appear in court within 48 court hours (Welfare and Institutions Code § 313). If your child has been removed, contact an attorney immediately.
You are not legally required to answer a CFS social worker's questions without an attorney present. You have the right to have legal representation before any formal interview. Anything you say to a social worker can be documented and used in a juvenile dependency petition.
A detention hearing is the first court hearing after CFS removes a child or files a WIC § 300 petition. It must occur within 48 court hours of removal. At the hearing, the judge decides whether the child stays in CFS custody or returns home pending further proceedings. In San Bernardino County, detention hearings are heard at the San Bernardino Juvenile Dependency Court.
